1. Acceptance of Terms

By downloading, installing, accessing, or using the Sylk mobile application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Sylk. Please read them carefully.

5. Subscriptions & Payment

5.1 Subscription Plans

Sylk offers the following subscription tiers:

5.2 Free Trial

New users receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial expires, your subscription will automatically begin and you will be charged for the selected plan.

5.3 Billing & Auto-Renewal

Subscriptions are billed monthly and automatically renew at the end of each billing period until cancelled. Payments are processed securely through Stripe. You authorize us to charge your payment method on file for each renewal period.

5.4 Cancellation

You may cancel your subscription at any time through the app's settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until your current period expires. No partial refunds are provided for unused portions of a billing period.

5.5 Subscription Lapse

If your subscription expires or payment fails, your account will transition to read-only access. Your data will be retained for 90 days, during which you can renew your subscription to restore full access. After 90 days of inactivity, your data may be deleted.

5.6 Apple & Google Subscriptions

If you subscribed through the Apple App Store or Google Play Store, your subscription is also subject to their respective terms. To manage or cancel an in-app subscription, use your device's subscription management settings.

Important: AI-generated estimates, suggestions, calculations, and analysis are provided for informational purposes only. They do not constitute professional, financial, engineering, or legal advice.

You retain full ownership of all data you create, upload, or enter into the Service, including project information, financial records, photos, reports, and client data. We do not claim ownership of your data.

By using the Service, you grant us a limited, non-exclusive, worldwide license to use, process, and store your data solely for the purpose of providing, maintaining, and improving the Service. This license terminates when you delete your account.

9.4 AI Output Ownership

AI-generated content (estimates, analysis, suggestions) created through the Service is yours to use for your business purposes. However, we make no representations regarding the originality or intellectual property status of AI-generated content.

The Service integrates with third-party providers including Teller (banking), Stripe (payments), Anthropic (AI), Groq (AI/transcription), Deepgram (transcription), Google Maps (location), Supabase (infrastructure), Expo (notifications), and Sentry (error monitoring). These integrations are subject to their respective terms of service and privacy policies.

15.1 Informal Resolution

15.2 Binding Arbitration

If the dispute cannot be resolved informally, you and Sylk agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

15.3 Class Action Waiver

You agree to resolve disputes with Sylk on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding against Sylk.

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets, with notice to you.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
